You agree that all information supplied by you to register as an Associate Member of TDI is true and correct. You understand that if you are submitting an application on behalf of another you must have the written authority to do so and will upon request be required to provide to the TDI the written authorization. The written authority must explicitly state that you have been given permission to submit the particular application(s) on behalf of another. You also represent and agree that you are in good standing with the TDI. You understand and agree that any misrepresentation submitted by you through the online registration process may result in the cancellation of the registration of your dog and your Associate Membership. Additionally the submission of false information may result in TDI refusing service, suspending or terminating your account without notice. By supplying your email address and/or telephone number, you consent to receive communications from TDI through these means.
Your Associate Member's Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and agree to accept responsibility for all activity that occurs through your account or password.
TDI does not allow for the creation of a Associate Member's Account by a person under the age of eighteen. TDI policy requires that dogs registered in the names of children be properly authorized by the minor's parent or guardian. With respect to an Associate Member's Account, this means the parent or guardian must establish, maintain and submit information on behalf of the minor.
TDI reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders or registrations in their sole discretion and without prior notice.
If you use the Associate Member's Pages of the TDI Web site, you understand and agree that all the information that you input into the records will be stored on TDI servers. You understand and agree that TDI will have access to and the ability to use this information. This will include but is not limited to use for determining compliance with TDI Rules and Regulations. Pursuant to TDI's regulations for record keeping you must maintain a printed copy (hard copy) of all records required apart from the computer storage or storage discs.
Indemnification
You understand and agree that you are personally responsible for your behavior on the site. You agree to indemnify, defend and hold harmless TDI, its employees, agents and any third party providers to the site, service or content from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting or arising out of your use, misuse, or inability to use the site, the service or the content, or any violation of the Terms of Use.
Disclaimer of Warranties
TDI MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE SITE, THE SERVICE OR THE CONTENT. TDI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGMENT, WITH REGARD TO THE SITE, THE SERVICE, THE CONTENT, AND ANY PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED VIA THE SITE. TDI DOES NOT WARRANT THAT THE FUNCTIONS PERFORMED BY THE SITE OR THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS IN THE SITE OR THE SERVICE WILL BE CORRECTED. TDI DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE CONTENT, OR THAT ANY ERRORS IN THE CONTENT WILL BE CORRECTED. THE SITE, THE SERVICE AND THE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
Limitation of Liability
IN NO EVENT WILL TDI BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INCIDENTIAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES, ARISING OUT OF (1) THE USE OF OR INABILITY TO USE THE SITE, THE SERVICE, OR THE CONTENT, (2) ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED BY THE SITE; (3) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE, THE SERVICE AND/OR CONTENT, (4) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR (5) ANY OTHER MATTER RELATING TO THE SITE, THE SERVICE, OR THE CONTENT, EVEN IF TDI HAS BEEN ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE, THE SERVICE, THE CONTENT, OR THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, TDI'S LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW.

YOU AGREE THAT ANY CAUSE OF ACTION, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATED TO THE USE OF THIS SITE, SERVICE OR CONTENT BETWEEN TDI AND YOURSELF OR AS TO THE CONSTRUCTION, INTERPRETATION AND EFFECT OF THIS AGREEMENT SHALL BE SETTLED BY ARBITRATION PURSUANT TO THE APPLICABLE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. HOWEVER, PRIOR TO ARBITRATION ALL APPLICABLE TDI BYLAWS, RULES AND REGULATIONS, AND PROCEDURES MUST FIRST BE FOLLOWED AS SET FORTH IN THE TDI'S CHARTER AND BYLAWS, RULES AND REGULATIONS, PUBLISHED POLICIES AND GUIDELINES.
